On March 24, 2016, the People’s Bank of China, together with relevant departments, jointly issued the Interim Measures for the Pilot Program on Mortgage Loans Secured by Rural Contractual Land‑Use Rights and the Interim Measures for the Pilot Program on Mortgage Loans Secured by Farmers’ Housing Property Rights. These two sets of measures set out clear policy requirements for financial institutions, pilot regions, and related authorities to advance and implement the pilot programs on mortgage loans secured by these two types of rights, covering such aspects as eligible borrowers, loan management, risk compensation, supporting measures, and pilot monitoring and evaluation. The Interim Measures for the Pilot Program on Mortgage Loans Secured by Rural Contractual Land‑Use Rights stipulate that the public ownership system must remain unchanged, the red line for arable land must not be crossed, and no tiered quotas may be imposed; moreover, the contracted land used as collateral must be free of any ownership disputes and its remaining term must not exceed the period of the farmer’s contract. The Interim Measures for the Pilot Program on Mortgage Loans Secured by Farmers’ Housing Property Rights specify that borrowers must have another long-term, stable place of residence and obtain written consent from the collective economic organization; when disposing of mortgaged assets, financial institutions are required to employ multiple methods and ensure the protection of farmers’ basic housing rights. Both sets of measures encourage local governments to establish mechanisms for compensating and mitigating loan risks—through interest subsidies, risk‑compensation funds, guarantees provided by guarantee companies, and other means—to ensure the smooth operation of the pilot programs.
